Colorado House Bill 08-1385 was passed and codified into law as 10-16-133 Colorado Revised Statutes. The law becomes effective January 1, 2009. The Division of Insurance has implemented an Emergency Regulation # 08-E-7 to explain the application of commission disclosures in the new law 10-16-133(5); what disclosure is required and whom must acknowledge the disclosure.  NEW! Clarification on Anthem’s Confirmation letter. Currently if your group gets an approval letter from Anthem, the second sentence of the first paragraph will list a Risk Adjustment Factor (RAF).

Please note, the RAF in this letter refers to the smoking load only. The final rates will reflect the combined SIC code RAF and the smoking load.

We have added the necessary forms for your compliance on the bottom of each client report. There are dual signature pages, one for you and one for he client. Both you and your client need to counter-sign, and you need to keep your copies for future potential audits. We are currently working on an upload that you can automatically upload the counter-signed "Commission Disclosure" and permanently keep it in your quoting system records.
